"Regardless of whether the decision to involuntarily transfer [Autumn] from GVIW to Millhaven constituted a deprivation of the applicant's residual liberty, I find it to have been reasonable and therefore lawful."
"Staff reported that [Autumn's] behaviour was  highly inappropriate, including playing with her penis and buttocks in a sexually suggestive manner."
"She barricaded herself into a shared common room with a broken television remote control that [Autumn] appeared to be attempting to use as a weapon. this incident lasted approximately eight hours."
"[Autumn] covered all security cameras in the common room. She threatened self-harm and violence against other inmates and CSC staff. Every attempt to speak with [her], even to offer her food, was met with verbal assaults."
"The incident finally resolved with the Institutional Emergency Response Team deployed a chemical irritant grenade into the common room and then restrained and extracted [Autumn]."
Justice Kristin Muszynski, January 6, 2026

"[The crime was so] horrendous and evil [it leaves no choice but to sentence the defendant as an adult]."
"Over the years [she] has been transferred between institutions on a number of occasions, usually due to [Autumn's] extremely problematic behaviour which Correctional Service Canada [CSC] reports has been difficult to manage in any population."
"[Autumn] was diagnosed with gender dysphoria [in 2014]. She served approximately six months in a women's institute in late 2017 before formally requesting to be transferred back to a male institution."

Claiming to be female, and aided in that absurdity by a 'medical diagnosis', a now-37-year-old man who at the age of 17 raped, tortured and murdered a young girl of 13 -- who with four others lured the child in Edmonton onto a golf course where she was sexually assaulted, strangled, stabbed,  and bludgeoned to death with a hammer -- feels entitled to be regarded and treated as a woman, and as such to interact with female prison staff only, and to be installed along with other females incarcerated after being found guilty of capital offences, rather than in a prison for males.

Born as Michael Williams, now known as Michelle Autumn, 'she' challenged involuntary transfer from Grand Valley Institution for Women (GVTW) to Millhaven Institute for males, in Ontario's Superior Court of Justice. The Attorney General of Canada along with wardens of both prisons involved, opposed this extraordinarily evil individual's presence in a women's prison. The shocking rape and murder of Nina Courtepatte in April of 2005 when Autumn was 17 years of age was so horrifically egregious that the presiding judge had little choice but to sentence the man as an adult. Where men's prisons with maximum security held him, for the most part.

Although he served some six months in a women's institution in late 2017, he formally requested return to a male institution. In 2024 he was installed in Voluntary Limited Access Range area at Millhaven Prison which "houses inmates who do not want to integrate into mainstream populations but are still considered to be subject to similar conditions of confinement to inmates in the general population. Gender-based accommodations are in place including non-emergency medical escorts, frisks, strip searches and security camera monitoring to be carried out by women staff members." An accommodation that truly suited this man-cum-woman.

Frisks and strip searches conducted by female staff at the prison on a biological male gave him the opportunity he so relished to flaunt his male sexuality in flagrant episodes of sexually aggressive displays. Which should have been recognized as more than sufficient indication that the diagnosis of 'gender dysphoria' was nothing but an institutionalized pandering to the manipulative whims of a dangerous sexual deviant and violent predator.

Then in November 2024 a transfer was arranged from Millhaven to the Grand Valley Institution for Women. Staff at the special unit informed Autumn he was expected to accommodate himself decently to the presence of others in a shared pod, if he wished to remain there.  Autumn was assigned to one of three pods housing nine inmates each on transfer, where he "was subject to the most restrictive level of supervision in a woman's institution".

Prison staff were confronted with the concerns of another inmate in the pod Autumn was sharing, who "expressed that she was uncomfortable" in the presence of the trans prisoner. Leading prison staff "to manage the concerns of this other inmate, but [Autumn's response was to threaten to assault or kill the other inmate if confronted again". He was then placed alone in a double occupancy cell in a different pod. When plans to move him again went awry he locked himself into a common room.

When finally he was transferred back to Millhaven on an involuntary emergency basis, the three-hour drive to the prison was not uneventful with the prisoner refusing to sit down, screaming abuse and urinating in the vehicle. The most recent psychological risk assessment concluded "that risk factors for future violence are high and the ongoing behavioural issues in the institution support this assessment".
The prison dilemma could readily be solved by placing the man securely in a barrel and setting it adrift at sea.
