Utterly Degraded Morals
Of all the repugnant and unbelievable machinations that modern legal defence can take, with the full assistance of the medical community willing to aid and abet by labelling as a newly-recognized medical condition truly abhorrent behavioural aberrations.
Recognizing it to be an unfortunate medical condition that a man could force a woman into sex, while in deep sleep. Effectively excusing a man for forcing himself sexually upon an unwilling partner must take first prize. Men insisting that they were not aware, as a result of being in a state of deep sleep, that they were raping a woman.
And the jury accepting it. No question of fraud on the part of the medical community who so readily lend their expertise to such behavioural anomalies. No regrets on the part of the clever lawyers who will use any means conceivable and some beyond the imagination to conceive, to 'win' at the arcane art of jurisprudence.
Taking great pride in helping their clients to walk away from responsibility. Anything goes in responsibility-averse, litigious societies.
Which brings us to another first. Surely a first? In Winnipeg, where a man insists he was raped, an unwilling participant in sex. He was, he insists, fast asleep in the home of a female acquaintance when he suddenly was awakened to discover his friend was in the process of 'having sexual intercourse' with him. He heatedly insisted she cease and desist.
And she did just that. Perhaps it was she who was sleep-walking, unaware of what was transpiring.
Nonetheless, a child ensued from that unfortunate union. And it is precisely that which represents this man's case. He is suing his erstwhile friend for damages, inclusive of mental distress - once a province of the woman involved. He is excited and insulted and has been abused beyond endurance.
Because he now must legally pay child support for that child born of forced sexual congress.
The man filed a statement of claim in the Manitoba Court of Queen's Bench, claiming damages. He insists on reimbursement for all child support expenses paid and payable in the future by him in support of this child he helped create but whose existence was forced upon him.
Yet another sad case of human failure.
