Mocking Justice

What an unspeakably vile travesty of justice. Demonstrating alarmingly, and yet again that money is capable of distorting reality.

To enable the legal defence of a woman without conscience and her defence team to evade and confuse the concept of justice by the costly and quite expert gaming of the system. Cleverly knowing what precedents to recall, what objections to raise, how to act the bullying interlocutor of witnesses whose memory and professionalism can be called to question.

Using the niceties of the law to successfully insist that leading evidence be set aside. Claiming the privileges guaranteed under the law which morally should not apply to the circumstances, but observing the letter of the law can be seen to be done. Convincing a malleable judge that he should find logic in their arguments, despite the frailty of the argument in competition with reality.

Pembroke resident, dentist Christy Natsis has been charged with impaired driving causing death. Responsible, under the influence of alcohol and an inability to utilize alcohol-impaired senses to their full advantage; incapable of acting, reacting and pursuing an intelligible thought process.

She was observed at the accident scene by first-responders to be exhibiting all the symptoms of inebriation; an awkward, typically inebriated gait, not fully aware, her face revealing evidence of inebriation, her breath reeking of alcohol.

She tested positive for having exceeded the legal limit of alcohol in her bloodstream - 2-1/2 times the legal limit. Her team of very expensive defence lawyers have cleverly pulled out all the stops in her defence, claiming her rights to a lawyer were violated; (on a truly slender thread where the truth lies in the balance of wealth) the presiding judge agreed to set aside evidential breath samples.

The woman has pleaded not guilty to impaired driving, driving with a blood-alcohol level over the legal limit and dangerous driving, causing the death of another driver -- Bryan Casey, when her SUV crossed the median into his eastbound lane, causing a collision with his Dodge pickup truck. A later examination gave evidence that Mr. Casey was also driving impaired with 1-1/2 times the legal limit of blood alcohol.

Generally speaking, men tend to hold their alcohol more convincingly than women are able to, with less evident cognitive and reactive impairment than women, and she had substantially higher blood alcohol readings than he did. Nonetheless, the defence is attempting to make it appear that the leading investigator in the case, OPP Const.Shawn Kelly, had consistently erred in his findings.

Contending that, in their expert analysis of the evidence and the witness statements heard thus far, that it appears convincingly to them that Ms.Natsis had remained in her own lane and not crossed over into Mr. Casey's lane; that in fact it was he, and not she, who had crossed into the opposite lane and caused the collision.

Const. Kelly explained that his professional examination indicated the tire treads on Casey's pickup simply did not match the treads in the gravel along the side of the road, that he found no gravel or mud in the treads of the driver's side of the truck, and that gouges and crash debris indicated the crash occurred near the shoulder in Casey's eastbound lane.

A reality that the suspect's defence will simply slough off in their inimitable manner, to point blame other than at their client, committing justice to an utter travesty. In other words, of course, committing a travesty of justice.
